THE PATIENT'S CONSENT TO TREATMENT

　Ⅰ．はしがき

　医師法第23条に，医師は診療をしたときは，本人またはその保護者に対し，療養の方法その他保健の向上に必要な事項の指導をしなければならないとあり，また健康保険法第13条にも，保険医は診療に当つては，懇切丁寧を旨とし，療養上必要な事項は理解し易いように指導しなければならないと記されており，また私の医事紛争10戒^3）にも，第4項，治療法，養生法は懇切に，第3項，承諾のとりつけは十分にと述べている所であり，私の病院でも最近は，多少なりとも危険を伴う可能性のある手術，検査の承諾書（同意書）の在り方を改め，主治医が病名，手術・検査の必要性およびそれに伴う多少の危険性などに関し解り易く説明し，患者および保証人の側も十分理解納得の上同意（いわゆるinformed consent）の意志表示を記載し，同時に両者の署名，捺印をする書式にしている。

　最近は，法的にもこのinformed consentが適切であつたかどうかが問題視されてきているが，最近米国のProf. Dr. G. RobinsonとDr. A. Meraw^6）が，このinformed consentに関する初の興味ある否貴重な研究を発表し，われわれ医師が熱心に十分な説明をした上での同意と考えていても，如何に患者の理解，同意が頼りなく，人間の記憶が当にならないかを如実に教えてくれ，われわれが医療過誤の問題のみならず，日常の診療面から見ても今一度真剣に考えてみる必要があると考え，敢えて，informed consentの問題を採り上げてみたいと思う。

　When the Doctor undertakes to treat his patients, he should obtain the trust and full consent of the latter. But in spite of such a consent the patient, afterwards, may raise a court case because the latter's discontent in the treatment. Why is it so ?

　As Dr. G. Robinson point out that man's memory is, at times, exceedingly unreliable, especially when a factor to the danger of life may be involved. That memory may be subject to being twisted, denied or in worst cases it may be designed by a complete fabrication. This is most unfortunate but none the less true.

　Therefore, when the Doctor acquires this consent for treatment from his patient, it deems highly necessary that he does it with utmost care and with a good clinical record.
