内視鏡外科の進歩をめぐる法的諸問題

Legal Problems Related to the Progress of Endoscopic Surgery

　内視鏡下手術には多様で特殊な合併症が発生することが明らかになってきており，特に導入初期に頻度が高く，かつ重篤なものが発生しやすい．内視鏡下手術を行う場合には，特に気腹操作に起因した特殊な合併症や出血・他臓器損傷の危険性，開胸・開腹手術に移行する可能性などを，対象が悪性疾患である場合には，さらに根治性に関する議論の状況や，後日の再手術の可能性などを患者に明確に説明しておかなければならない．近年の動画像伝送技術の発達により，専門医が遠隔地から通信回線を用いて内視鏡下手術を指導することも可能となったが，その実験性や情報漏洩の危険性についてのインフォームド・コンセント，医療事故が発生した場合の責任関係，通信上のセキュリティー確保などの法的問題がある．

Endoscopic surgery has spread widely and is currently used in a wide range of thoracic and abdominal surgery. However, it has be come clear that there are various complications including those related to pneumoperitoneum, unexpected bleeding and injury to other organs. Patients must be well informed about these risks before they consent to endoscopic surgery. Moreover, when the endoscopic surgery is applied to patients with malignant diseases, the patient must be correctly informed that radicality and indication of endoscopic surgery is still controversial.
