耳鼻咽喉科領域における診療事故判例

THERAPETIC ACCIDENTS IN OTOLARYNGOLOGY

　I．はじめに

　ある耳鼻咽喉科医が，扁桃摘出を行なつた。ところが，術後手術部より出血が起こり，ついにはその出血が気道を閉塞し，患者は死亡した。この事件は患者の遺族の訴えにより，司法解剖に付された。著者はこの解剖を介助して感じたことをつぎにのべる。

　剖検後，担当医に状況をいろいろ尋ねたのであるが，終始，「手術はいつもと変らない程度のものであり，不可抗力である……」といつたような主旨の弁明であつた。一般に診療事故が発生すると，多くの医師は，いつもと同じようにした。また，不可抗力であつたと説明しがちである。このような説明は，今日では通用しないと覚悟しなければならない。つまり，いつもと同じということは，慣行を意味しており，法的審理を受けると，その慣行が如何に適正であつたかと，究明される。また，不可抗力云々についても，同様である。診療上，果すべき注意義務が如何に遂行されたかについて，徹底的に追求されるのである。

　Whenever any accident may inadvertantly happen in the treatment of the patient the criticism against the doctor from the standpoint of the patient including hie relatives or from the society as a whole is becoming more and more cold and severe with recent changes in the social concept.

　The author has collected these complaints from the court records of recent years which are amazingly large in number.

　To avoid such a tragedy the therapist should be complelely oriented to the situation under which he works.
