医事訴訟鑑定について思うこと

NOTES IN DELIBERATION ON MEDICO-LEGAL CASES

　今次大戦後急速に起つた民主主義は政治思想がまだ未熱であつたわが国においては，権利義務が先走り一部誤つて世間に滲透されるに従つて，以前はこともなく片附いていた各種の事故が人権という名において論議が行なわれるようになり，世事百般復雑化するとともにいろいろの紛争は増加の一途を辿つている現況である。

　医療の世界も例外ではない。最近医事紛争は目立つて多くなつて来た。医道のモラルの問題は別としても，国民皆保険，低医療費診察の現今，一挙に多額の賠償や慰籍料が課せられることは，医家にとつて経済的にも苦痛であるばかりでなく医師の診療意慾を阻害すること甚しい。

　The author makes note of various points that impressed him deeply in the medicolegal trials to which he was called as an expert witness.

　The reason why so many cases in the specialty of otolaryngology come to legal controversy is sought by analysing and classifying these cases; the limitation to which any expert witness may be bound is also mentioned.

　The attitude of the individual doctor which might be adopted against a possible legal controversy that occurs recently in a considerable number is discussed.
