医療刑務所における出口支援の現状と展望

Current Situation and Prospects of Exit Support in Medical Prison

抄録　刑務所に入所する受刑者における精神障害を有する者の割合は増加傾向にある。医療刑務所では，入院レベルの専門的な精神医療が必要と判断された精神障害受刑者を受け入れているが，出所の際にはさまざまな困難を抱えている。大きく分けると，地域移行の問題，病識の欠如と同意の必要性，26条通報のハードルの3つに集約されるが，これらの困難の背景には，刑務所から出所する精神障害受刑者に関する法システムの不備不足が存在すると考えられる。今後，精神障害受刑者の地域移行が重要な課題になると推測され，諸外国のシステムなどを参考に，日本においても矯正施設からの出口支援について再考する必要があると言える。

　The percentage of inmates with mental disorders in the prison population is on the rise. Medical prisons accept inmates with mental disorders who have been determined to require specialized psychiatric care. But there are several difficulties at the time of release. Broadly speaking, these difficulties can be summed up into three categories：problems in transitioning to the community, lack of awareness of illness and the need for consent, and the hurdle of Article 26 reporting. Behind these difficulties lies a lack of a legal system concerning inmates with mental disorders being released from prison. It is assumed that the transition of inmates with mental disorders to the community will become an important issue in the future, and it is necessary to reconsider the support for exit from prisons in Japan, referring to systems in other countries.
